Preamble to the Constitution for New California 

We the people of the state of New California in order to secure the blessing of liberty,  equality and justice to ourselves and our posterity do and ordain this Constitution  for the state of New California

Supremacy of the U.S. Constitution

This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

Federal Laws  deemed by two thirds of members  of the state legjslature to be uncostitutional shall  be declared null  and void in the state of  New California.

The  job performance of members of the state assembly shall be judged by members of the state senate and the job performance of the senators shall be judged by the County Board of Supervisors. 

The powers not delegated to the State of New California shall be reserved to the counties respectively, or to the  people.

The state ahall guaratntee to the peope a republican forn of governmen and will guarantee tthat  the  county governments shall respect the peoples right to their lives, liberty and property.

The state  shall  guarantee that each county has a well  trained and adequately equipped miliita to provide for the common defense.

Tge sttate shall guarantee that each county shall  have an indendent grand jury to investigate the misconduct of members of the legislative, execcutive and judical branches of the state, county of city government, 

The state shall be responsible to operate state prisons,  state parks and state colleges and universities. Education of children shall be the responsibility of the parents, churches and private schools.

Article 1 - Legislative

The legislative branch of the state government shall consist of a bicameral legislature with a lower house to represent the people and an upper house to represent the counties.

The people in each of the counties will be represented by one member in the state assembly for every 50,000 residents as determined by the most recent census. An election will be held every second year in each of the assembly districts

The members of the state assembly serve two year terms and may not serve more than than  a total of four years.

Each county shall be entitled to one senator. The senators will be appointed by the county board of supervisors for a term  of four years.

The govenror and all other executive officers shall be nominated by the members of the state assembly and confirmed by the members of the state senate.

Artticle 2 - Delegated & Prohibited Powers

California shall be a right to work state.

California shall provide services that are absolutely necessary and proper to the people  that can not be provide at the city or county level.

California shall provide the people of California with free water and electrical power.

The state shall have the authority to monitor and regulate all corporations and to break up monopolies in order to prevent their abuse of power.

The state shall build and maintain the public roads, bridges, dams, levees and freeways, 

The state shall oraganize and supervise the training of the militia in each county.

The state shall guarantee that each county will have an independent citizen's grand jury..

All non essential buildings and land owned by the state shall be transferred to the county where the property is located. 

The state shall prepare an annual budget and will have the authority to tax each county their portion of the liability based on their population.

The state  delegate to the counties the responsibility to supervise the eduation  of the children within their jurisdiction. 

The state shall pass laws to protect consumers from the abuse of power by corporations.

The state shall responsible to run the Department of Motor Vehicles.

Article 3 -Judicial Branch

Any decusion of  the Supreme Court of the State of New California may be overturned by the concurrence of two thirds of the members  of the  state legislature,

The performance of all state and county judges shall be evaluated every two years in order to be qualified for re-election they must be approved by the  majority of the members of the county board of supervisors.

All persons accused of a crime shall be presume innocent until proven guility by a unanimous verdict by an impartial jury of their peers.

The use of sobriety checks points and the use of red light cameras are prohibited.
If there is no victim there is no crime.

In order for an individual to be convicted of a crime the must be an injured party who is willing to testify in court that the person accused violate their lives, liberty or propety. The city, county and state are legal fictions and can not be a plaintiff in a court of law.

All people accuse of a crime must have a jury trial and no one accused of a crime will be allowed to accept a plea bargain.

Civil asset forfeiture shall be prohibited

Article 4 - Amending the California Constitution

Upon the approval of two thirds of the members of the state legislature and a ballot proposition approved of by two thirds of the people

County Government

The Board of Supervisors in each county shall prepare a charter that defines the proper role of their county government and lists all  powers the  people of the  county wish to  delegate to their county. All powers not delegated to the county shall be ratained the cities, towns and unicorporated communities.

This is just a draft of a proposed new Constitution for the  state of New California. There will be many changes before the final  version is completed.

In the Constituion for the united States titles of honor or prohibited. The title granted to a lawyer or a doctor is a title of honor and the granting of that title is unconstitutional.
