Because we have the Sixth Amendment anyone accused of a crime is entitled to a trial by jury. To whit:

"In all criminal prosecutions, the accused shall enjoy the right to...a public trial, by an impartial jury of the...district wherein the crime shall have been committed."

Today that right is denied to 98% of the people facing criminal charges. Why?

Rather than facing a possible conviction for a serious offense, many of those accused plead guilty to a lesser offense and of which many have not even committed any crime at all. No victim, no crime. Sound familiar? It should.

In many cases the possibility of being found guilty by a jury is a risk that most defendants are unwilling to take. As a result they plead guilty to a crime they didn't commit in order to avoid the risk of a longer sentence. The system that was created to provide equal justice is now convicting people of crimes they didn't commit without a jury trial.

I personally believe that we should pass ordinances in our counties that would make plea bargaining illegal. People who are accused of a crime should face a jury trial to determine their guilt or innocence. When defendants plead guilty to a lesser crime both the victim and the defendant are robbed of justice,

The guilt or innocence of a person accused of a crime should be determined by a jury of their peers and not by judges and prosecuting attorneys.

An individual who has not committed a crime should not be convinced to plead guilty to a lesser crime to avoid prosecution.

When a fully informed jury is in charge the people rather than the judges and the attorneys are in control.

  • Fully informed juries would curtail much of this nonsense.  

    • But the issue is getting to a jury trial. Keith's article is discussing people who plea out in order to avoid a jury. If you go the jury route, be sure to organize all your local patriots to hand out jury nullification pamphlets around the courthouse since a corrupt judge may not allow that to be brought up in defense.
