Rescinding the 17th Amendment

When the 17th Amendment was submitted to the states for their consideration there were 48 states and 36 state legislatures vote for its ratification.

The legislatures of Delaware and Utah voted to reject it and 10 other states refused to ratify it.

A provision in Article V guaranteed that no state can be deprived of equal representation without their consent,  The twelve states that refused to ratify the proposed amendment did not give their consent and should not be subject to the unconstitutional 17th Amendment.

There are currently 41 states that have ratified the 17th Amendment. Delaware voted against the ratification in 1913, but in 2010 they decided to change their vote to the affirmative. If 6 of the 41 states change their ratification vote the number of states to ratify would be reduced to 35 which would cause the 17th Amendment to be rescinded,

Utah, Mississippi, Kentucky, Georgia, Florida, South Carolina or Virginia have not given their consent to surrender their Constitutional right to be represented in the senate. Do the 41 states that have ratified the  amendment have right to deprive the other states with their representation in the senate.

    With 36 states having ratified the Seventeenth Amendment, it was certified by Secretary of State William Jennings Bryan on May 31, 1913, as part of the Constitution. The amendment has subsequently been ratified by:

39. Delaware – July 1, 2010 (After rejecting the amendment on March 18, 1913)
40. Maryland – April 1, 2012
41. Rhode Island – June 20, 2014
