Dear Department of Motor Vehicles Director,

I have some questions regarding the application of the “motor vehicle” codes. As your organization is the prime testing and “licensing” agency for “drivers”, I believe it is incumbent upon your agency to provide redress for any questions arising out of confusion with the statutes/codes/case law, etc. in reference to these areas.

As I cannot make future decisions based simply on MY interpretation of what I think a pamphlet or publication says and I cannot interpret law as I am not a lawyer, I require written confirmation directly from you as to the exact stance and beliefs of your office in regard to my questions and as such, a cookie-cutter response of pre-printed sales fliers will not be sufficient as a reply to my questions. I require you adhere to the administration of your duties as director of operations of your particular office, and answer my questions individually and in writing.

That is why this letter is addressed to you personally and directly. You are the leader and therefore I must assume, the highest authority on the practices, policies and official “legal” stance on ALL aspects of The DMV and the lawful relationship set up between the DMV and those who fill out and sign an application for a “driver’s license”.

As it is a right of the American people to petition their government for redress of ANY grievances and you are a government agency, I consider a response to my questions MANDATORY on your part. I will accept nothing less than full cooperation from you with THIS official request for information. I require this information in order to make legal decisions that very much will affect my future, therefore it is extremely important that I receive accurate information regarding my questions. Your response(s) will be necessary to effect future decisions on my part. That is why a pamphlet or stamped out response will not be sufficient as a proper reply.

As I understand this may be asking for a little extra effort on your part I have prepared the flowing separate page(s) to simply be filled out, copied and returned to me with answers and full U.S. Code and law references included. If the form is incomplete or blank, the answer will be considered to be null and void as a proper reply to a request for information.

I’m sure you believe that most if not all of the questions I have can probably be addressed by a flier or information pamphlet, but that would not be sufficient for the reasons previously stated in regard to my issues, hence;

My questions center around the claim by the DMV that in order to “drive” or “operate” a “motor vehicle”, or obtain a “driver’s license”, that I need a Social Security Number. If this is accurate, then the following questions arise. To whit the following;

1) Can the government require a man or woman born in America to obtain a “license” in order to move their property from place to place in the mode of the day for private purposes, who is not involved in traffic, commerce, ferrying passengers, carrying cargo or trade for profit on the roadways?

Great Letter.  Think I will print and send it off just for shits and giggles.  

I came across a letter the other day while researching Treasury Delegation Order FOIA request.  This was a gem of a find for me.  As a diligent researcher, to find everything in one place, all tidy, was just thrilling.

Written by a John B. Nelson, back in 92.  Anyone familiar with this name?  I am curious where he is today?

I've heard of Richard X. Nelson. Not sure about Johnny B. I am familiar with the fact that better formats than mine exist and I'll probably even use them when sending out "official mail". It will be done with letter head, cover sheet, etc. and in a set format. Any link to good forms is appreciated though.

You GO, Morton !!  I'm fw to emails & slamming all over fb to 5-6 groups I'm in. Let mine expire 2-3 yrs. ago & never renewed as MY form of protest. Too old & sick to actively fight in court, however, if stopped, I'm going to reply...."go ahead, do what you think you have to do. 3 hots & a cot don't look too bad to me right now !" A sort of passive-aggressive attitude to take I guess, but I didn't forget 55 yrs. of driving experience w/ an ambulance & fire trucks because of a damned piece of paper !    Whoop, whoop !!

You are a hoot. You make me realize I'm definitely doing the right thing. You see, if it's OK with you old folks, it must be good.

Morton, your letter is just fine.  Sometimes we get caught up in the details, when plain simple English will suffice.  I have a saying: "over analyze, get paralyzed".

Your Answer: I do not believe that all licensing is unConstitutional. In some circumstances, like Driver License, is a way to qualify and record competancy.

I, for one, feel better that “most” folks on the public roads, have Driver Licenses and can drive fairly well, without everyone crashing into one another. It also serves as an ID. The Social Security on the Driver License should NOT be there.

Your Answer:    Don’t know, but I despise showing the SS# and it's "tracking" capability. This is totally abused by the govt.

Your Answer: I doubt it. But try getting a bank account without it, etc, etc, etc...might as well be #666 as far as anyone is concerned.

Your Answer: Thought DMV was a sub-contractor for State Govt., and feds impose on this for Interstate Commercial OTR Carriers, et al, with DOT. Is it a law or legal ? Probably not.

If you get an answer, let us know.  It would be evidence should you be stopped for an infraction and you could show it to any code enforcement officer.

This all related to SS and it being VOLUNTARY.  From their own publications and response to request to discontinue it use.  

Now the 64k question, how the hell do we continue to function in the customs of almost mandatory necessity?  The SS Manual explains this in great detail. (attached) I conducted an experiment by taking the info to open a bank account (i knew the wouldn't open w/o ss#, but i wanted to find out first hand)  The law is clear, The Privacy Act states they cannot demand this info and state it is FED LAW.  Which of course they will do.  The bank stated this very thing, which is punishable by a fine of $1,000.  Long story short, I didn't make any friends at that bank.  Proved to myself they have no idea what they can and cannot do, lawfully.  If I wanted to pursue charges for violation of FED LAW, Privacy Act, I could have.  But these days have to pick your battles.  And that was not one I was interested in spending what little time I do have for more important causes, at least to me.

Oh, and one more thing which I am sure you are all aware.....if you withdraw, you waive the benefit(s).  

A traveler does not require benefits.  Only 14th Amendments citizens are subject to the jurisdiction (benefits) of the United States, Inc. or whatever else the corporations call themselves. The DMV benefits are that you get to pay them taxes for an automobile they have title to and another tax to travel in that automobile. Quite a scam.
