The Fair Tax

And what’s wrong with it!

Here are the main problems I have with the proposed Fair Tax.

  1. Those in favor of passing this legislation claim that it first requires that we repeal the 16th Amendment. This is a false notion fueled by ignorance of the law. The Supreme Court said in Stanton Vs. Baltic Mining Co., 240 US 112 (1916), that the 16th Amendment does not change Article I, section 8 of the Constitution, and confers no new power of taxation. Therefore repealing the amendment will change nothing and will not, in and of itself, eliminate the IRS. Therefore, even if one could successfully repeal the 16th Amendment, the proposal is doomed from the onset. Other Supreme Court case law as in Brushaber Vs. Union Pacific Railroad Co., 240 US 1 (1916),  is being used as the legal backdrop for the authority to continue the fraud known as the Income Tax, so repealing the 16th Amendment will not be enough.
  2. The proposed sales tax claims to be “revenue neutral”. This means that it will do nothing to change the amount of money going into the coffers of the federal government. This does absolutely nothing to make the feds more fiscally responsible, which is what they claim to be trying to do with the Fair Tax proposal.
  3. Because this is a sales tax and is “revenue neutral”, it’s too easy for everyone to lose track of how and where they are taxed, thus allowing the government and the public at large to easily forget that there is a tax being levied in the first place, and;
  4. This makes it too easy for the tax to be increased by fiat, any time they feel like it. And don’t tell me that it will have to be voted on, because when you rob Peter to pay Paul, you can always count on the support of Paul. In other words, those constituents who benefit from government giveaways will always vote in favor of increased taxes. Eliminating giveaway programs is first and foremost at the heart of the problem, not eliminating the IRS. And:
  5. Wasteful spending by the fed will not change just because the money comes from a different place. Reform needs to be based in correcting the problems that we know exist now, not in changing the source of revenue.
  6. In addition, there must be serious reform of the corrupt cycle known as lobbying. When a politician can be persuaded to vote in favor of passing a law for a particular corporation to receive money based on the amount of begging and influence peddling they engage in, this is a problem. The Fair Tax will not change this.
  7. Also, the government is in the habit of ignoring the will of the people in the first place, so what will stop them from simply printing more fiat money any time they feel like it? The answer is NOTHING. And:
  8. Last but not least is the fact that taxes, like the economy, trickle down to the bottom. When corporations are taxed, industry wide, they do not actually pay the taxes directly. They either move the operation to a tax free environment, thereby eliminating American jobs, or they simply increase the cost of the end product to cover the increased taxes and the CONSUMER pays a higher price at the end of the line. So poor people end up paying the increased taxes levied against the “evil rich and competition will not keep corporations from raising the price of their products, due to the fact that the regulation or tax that increases those costs for a product are levied against an entire industry all at once, in order to make it “fair”. Some perfect examples are cigarettes, alcohol, beef, milk, etc. You name it, the fed has found a way to tax or regulate it, INDUSTRY WIDE. They don’t just tax or regulate one company, they tax them ALL, and the CONSUMER PAYS THE BILL. The Fair Tax WILL NOT CHANGE THAT. That’s trickle down economics 101. If you need proof, check the latest tax returns filed by Goldman Sachs, AIG, etc. You’ll see that not only were they able to differ an income tax liability of TWO BILLION DOLLARS by shipping jobs over-seas, they actually qualified for a TAX CREDIT of over ONE BILLION DOLLARS MORE, on top of that! We must eliminate the IRS AND STOP THE PAYMENTS. Not change the way they get the wealth.

In conclusion,

It is safe to say that the Fair Tax will do ABSOLUTELY NOTHING to change what’s wrong with our federal government in terms of how they borrow and spend and print new FRN’s (Quantitative Easing), anytime the Fed says it’s the right thing to do. Not to mention the Fair Tax does nothing to address the fact that they routinely ignore requests now for freedom of information and Redress of Grievances in regard to taxes and other issues. The fed will not change their attitude until “We The People” force them to.

Stop the "voluntary compliance" with the misapplication of the current Internal Re-Venue Codes. This would immediately cripple the fed and wake them up. The Fair Tax WILL NOT! Instead, it will bury the issue of an overblown and corrupt government and put it on the back burner of the American conscience. People will continue to fund a corrupt, wasteful, SOCIALIST government. That’s why I don’t like the Fair Tax.

  • The only real solution to these issues is, dissolve the corporation illegally running our Country into the ground and return to the original Constitution of the united States of America.  We have a means of returning to this original Constitution of the united States of America in place now, it is the Republic of the united States of America.  Read about it, investigate it, research their thoughts and if you like what you see and hear, then join with them in the quest to return to the original Republic established by the founders of this Country. The Republic of the united States of America is entirely peaceful. The choice is yours, we need your help to make all People free once again.

  • The 16th Amendment states that only Congress has the authority to collect taxes, not the Secretary.

    The Tax Code is perfect.  Nowhere does it name an American Citizen to be subject to the income tax.  When the Tax Code defines, in 3 sections, citizen of the United States, it’s not me (or most Americans). See Chapter 2 SELF EMPLOY, Statutory definition 1402(b) An individual who is not a citizen of the United States but who is a resident of the Commonwealth of Puerto Rico, the Virgin Islands, Guam, or American Samoa.

    Chapter 21 FICA, FEDERAL INSURANCE CONTRIBUTION ACT, Statutory definition 3121(e): An individual who is a citizen of the Commonwealth of Puerto Rico  (but not otherwise a citizen of the United States).

    Chapter 23  FUTA, FEDERAL UNEMPLOYMENT TAX ACT, Statutory definition 3306(j): An individual who is a citizen of the Commonwealth of Puerto Rico or the Virgin Islands (but not otherwise a citizen of the United States). 

    There is no statutory definition of citizen to rely on in Chapter 1, the income tax section of the code.

    To give any credibility to the FAIR TAX is letting the government off the hook for committing crimes of extortion and other crimes for the last 100 years. WAKE UP AMERICA!

      Couldn't have said it better myself. The SCOTUS also said that the 16th Amendment gave no new powers of taxation that weren't already in the Constitution, but simply kept the tax from being removed from the category of excise taxes.

      As for the IRC's, you're exactly right, "Nowhere does it name an American Citizen to be subject to the income tax." In fact nowhere within the proper section of the tax code does it define income and in addition, the 861 Source issue has never been settled. 

      You remind me of another Chris; Chris Hansen who wrote The Great IRS Tax Hoax. I think you hit the nail right on the head. So when does the rest of America begin to learn this and STOP PAYING INCOME TAXES? Instead of introducing a Fair, Flat or VAT Tax, we should be focusing on the FRAUD by our government and the fear and intimidation they use to scare people into paying a fee they DO NOT OWE !

  • I am in 100% agreement with you, and have been saying all along that the So-called Fair Tax would only be a way of making legal, a tax upon us that never was legal before.  I have always believed the proposed Fair Tax is nothing but a TRAP, and should be avoided at all cost.  The rightful way back to the Organic Constitution, and Personal Liberty is to do away with the Totally Illegal Income Tax, and the IRS, and repeal the Un-ratified 14th amendment, and restore the 13th Amendment.   Thank you for this article, I am always relieved to find that I am not alone in my understandings!  As an addendum, and as an urgency, we must rid ourselves of the UNITED STATES OF AMERICA Inc. and restore the United States of America.

  •      The Fair Tax would be unfair and would continue to fund socialist government.  Maybe Thomas Jefferson can give us some insight on a way out:

         "Taxation is, in fact, the most difficult function of government and that against which their citizens are most apt to be refractory. The general aim is, therefore, to adopt the mode most consonant with the circumstances and sentiments of the country." --Thomas Jefferson: Introduction to Tracy's Political Economy, 1816.

    A mode of taxation that is "most consonant with the circumstances and sentiments of the country" will be one that is fair, that will put the heaviest burden on those best able to bear it, and that "shall not take from the mouth of labor the bread it has earned." A consumption tax that does not tax essential items needed for living would seem to fill the bill.

  • All 50 Governors need to recall the illegal Representatives and Senators in the House and Senate of the Federal Government since a legal Congress has not sat since 1859 or 1860 thereabouts.

    First step would be to either re-appoint them back to the Original Senate Prior to the Civil War and the closure of the Congress illegally; or, to appoint (through State Legislative Rule) the new Representatives and Senators.

    This resets the Constitution prior to the Civil War, and all laws passed in the make-shift government of the Corporate US would be null and void.  (OOPS, that includes IRS, Fed Reserve, and any other Corporate Business unit of the Corporate US).

    I read over the weekend that someone has been discussing this point of view outside of these discussion groups.

    It must make sense to some level headed business men.

    As far as level headed Politicians, the only way to ever tell one is when you see TOBACCO JUICE dripping out of both sides of their mouth.  And, never get close to one of these because tobacco juice stains the shine on your shoes.

    • It would be hard for those Governors to do that, Osceola! On March 30 and 31, 2010, the Republic sent out LNLs (Lawful Notification Letters) to each and every one of the 50 Governors, letting them know that they needed to step in and re-inhabit their "Republic" seats and take their proper Oaths. Not one Governor responded; they all acquiesced, just as we were told they would. They are not legitimate in the Republic either, so how would they have any authority to remove anyone else that does not have the authority to be in their position?

      That scenario is what permitted us (in the Republic) to step forward and re-inhabit the Republic seats that have been vacant since the creation of the corporate UNITED STATES in 1871. It was done on November 20, 2010. The governors were told they had 21 days to respond, but were actually given May, June, July, August, September, October, and most of November. They all acquiesced! They lost their chance, and they are now out!

      The real, legitimate Republic has been re-inhabited, and we are now up and moving!

        If the Republic for the united states of America acquiesced. When you gave the Governors 21 days and they did not respond, did you send them all Notices of Default as the Law requires?

        If not, then you and the RUSA actually were no longer operating within the rules and automatically must be held as in acquiescence to the rules of procedure which Demand that once the Governors of the Fifty states do not, or refuse to respond you MUST, I repeat MUST send a Notice of Default and follow through with proper procedures to continue in a lawful manner to re-occupy those seats.

        If not, I can see why some might have the opinion that RUSA is no more legitimate than those you purport to replace. You MUST follow procedure "in law" and give proper Notice of Default to be within the laws you want them to follow. After Notice of Default is ignored, then you may proceed forward with any further action in that vain to re-occupy those seats.

        This is clear and unambiguous "in law" procedure. Also notification to the general public, which would involve every newspaper in the usA and proof of service to each and every Governor of that N.O.D. must be published for the whole thing to even come close to being considered a legitimate and "lawful" action by RUSA or anyone else.

        If nobody has even been told in an unassailable fashion, then you are going to have a hard time selling this idea that RUSA is legit and everything they have done is now law.

        Does any of that make sense?
