They invariable will convince the people that they must voluntarily give up a portion of their individual liberty in order to achieve public safety. In a Republic, the people are free to do whatever they want as long as they do not violate the rights of others. In a totalitarian state the people must be given permission before do anything.

In the totalitarian state a crime occurs whenever a person breaks one of their rules. The Founding Fathers drafted the Constitution to prevent the abuse of power by elected officials.

Even though their intentions might be honorable, an elected official can not lawfully deprive the people of their rights under the pretense of taking care of them. Officials that put the best interest of their community ahead of the rights of the individual plant the seeds of tyranny.

We need to separate the sheep from the goats. We need to identify those the truly believe in the Constitution and those that give lip service to the Constitution and fail to honor their oath to preserve, protect and defend it

  • The constitutions [ state and federal ] create the respective gov and define the max powers of that entity.  As the SCt has always said, the gov cannot lawfully exercise powers not clearly defined or clearly implied in order to carry out the clearly defined powers.

    That being said, the gov was not delegated the power to simply place everyone under marshal law.

    I wish you had read what I posted on the creation and application of the 14th amendment and the powers of the gov over those people who's citizenship was created by the 14th. Then look at all that the gov is doing.  It then becomes clear that the gov is pretending that by some magic that everyone is a 14th / fed subject and that there are no state-only citizens left.

    Citizenship:

    Citizenship in a country that has been conquered and is no longer in rebellion.  - Very few rights.  They are under the Art 4 powers of the United States wherein congress has the power to make all needful laws and rules. The main limitation, congress cannot impose laws and rules that only serve to oppress.

    14th citizen.  Allowed to live in a state. Basically on par with conquered people no longer in rebellion.  They are called 'citizens of the United States [ fed gov ] a.k.a US citizen.

    Citizen of a territory.  Have a lot of common law rights.  The bill of rights was written for them.  They have lots of rights because the land they are on is destined to become a state and they are destined to become a citizen of a state..

    Citizenship of a state.  Highest level. Sovereign with a right to a republican form of gov.  Their rights are suppose to be secured by their state constitution. Each state constitution has a bill of rights for that reason.
