Judicial branch courts are common law courts. These are legislative branch and cannot see the common law. Before getting into serious trouble, get some minor traffic ticket such as for no seatbelt and try and beat that. If you cannot beat that, you will not be able to beat a driving suspended ticket - which in Oregon means a min of 20 days in jail.
I have been studying and researching all these things since originally being stopped in Hawaii back on Columbus Day, Oct. 12, 2017. I just recently discovered the "Refusal For Cause" pronouncement after also discovering a website BeatTrafficTickets.org owned by Thomas Eliot (1st & middle name) and a free downloadable book called "Common Law Remedy To Beat Traffic Tickets". I got more of of that one free book than all of the 27 videos I purchased from Bill Thornton, and please - in no way is that meant to Dis Bill because there is so much information on Bill's videos, its hard to even begin to put a legitimate price on. I paid $70 for 27 DVDs including shipping. Just the price of blank DVDs is more than that.
But to get back to Thomas Eliot, I must admit that after reading through the 65 page book, I was totally enthralled discovering the things he freely shares and explains. He also responds personally when asked questions. Tonight will be my first interaction with Jacquie Figg at her on-line Zoom meeting - subject UCC and DMV filings. I am very much looking forward to that meeting. I was very excited to first watch her video, attached to Jerry Day's site after 1st watching one of Jerry Day's videos. It seems that people are coming from everywhere, to all help each other and give as much information as possible to try to help us all break free of the seemingly unbreakable governmental (State & National) "rules & regulations".
My auto is tagged, registered, inspected, insured, etc. If I was the only one to use it it probably would not have any of the foregoing, but my wife of 50 years uses it more than I do and she is not that well versed or confrontational as I am.
That being said, it does not change what the auto is used for-private travel. Federal law makes it fairly straight forward that driving is a commercial activity-that of hauling goods or passengers for hire. State statutes conveniently leave out part of the definition because if they spelled it out the public would wake up and the State would lose billions of dollars in revenue.
Yes, the State has legal title to your auto, that is, unless you paid cash for the auto and demanded, as per their statutes, the Manufacturers Certificate of Origin. The MCO is legal title and any time an auto is financed the title is presumed to be in commerce and is sent to the State. You are given a Certificate of Title [which is not the real title but is proof that the title exists somewhere] which only conveys equitable title to you, granting you time, possession and use as long as you follow their rules and pay all fees and taxes related thereto.
Once the auto is paid off the legal title should be returned to the lawful owner, but the State fights that because they want to keep stealing from you. I did make an attempt to retrieve legal title to my auto but they pulled the old attorney trick and just sent me an 'un-certified' copy of the MCO. I will continue to try to force them to produce a certified copy.
As to going into their administrative courts, they never charge you with anything as they can't see the living. They charge their all caps straw man and when you show up to defend they merely see you as the fiduciary for their SM, one who is 'appearing' to pay the fine and do the time for their SM.
There is a tremendous amount of material available on the net on how to fight their phony authority. Unfortunately, most don't have the inclination to study their remedies and few have the courage to employ them. As long as we just continue to wave our fingers and moan about what is wrong, not a whole lot will change as to our circumstances. What we really need is practical commentaries from people who have been in the trenches to give those that do have the courage the necessary ammo to fight back. This corrupt system relies on our fear driven continued subservience.
I think the main topics should revolve around income taxation, driving, property taxes, the courts, and learning how to rebut their presumptions of citizenship [impossible for a living man to be a U.S. citizen] or fiduciary for their SM.
You are correct Bill. That is why you must "Refusal For Cause" all correspondence with these shysters. You never "appear" in "their" Admin courts.
It is my experience that a lot more people drive without a license out of necessity and always pray they don't get caught than out of intent. The fact is that you cannot argue the right to travel in any trial court today.
The reason is actually very simple. All judicial branch trial courts have been replaced by legislative branch courts for many decades. The current courts have no authority over people who have actual common law rights - such as the right to use the highways for non-commercial purposes. They only have authority over 14th amendment citizens which have almost no rights.
If you argue a common law right in a statutory court, the judge sees you as incompetent and ignorant and simply steamrolls over you. I have even seen the jury stacked with only cops and relatives of cops to stop a person from winning.
If you have a right to travel, then no constitution grants these courts any authority over you, thus the only logical and available option is to deny the court has jurisdiction.
Then you need to know exactly what few words to use in your denial and why those words are important.
My question to those of you who say they drive without a license are you buying license plates? If so does that not convey that you are plating your vehicle as a commercial vehicle.

I agree. I have been traveling in my private conveyance for 22 years without a license. I was stopped in 2002 by a county deputy. I told him I wasn't in his jurisdiction since he was enforcing the transportation codes which defined 'driving' as the commercial activity of carrying goods or passengers for hire and I was merely traveling as a right protected by the Constitution. He acted like he was quite surprised and told me I needed to get a drivers license and sent me on my way.
Had he given me a ticket, I would have taken it to the clerk of courts and returned it as a refusal for cause. The cause being that the officer had no jurisdiction and I choose not to contract with them.
