It's time to take a look at what the "Framers" of the Constitution actually wrote.

Take a look at the General Welfare Clause, The Commerce Clause, Article 1, Section 8, Clause 11, Article 1, Section 9, Clause 3 & 4, and then look at the Articles of Confederation, particularly article 12.

From Black's Law 1st. edition:
CONFEDERACY. In criminal law. The association or banding together of two or more persons for the purpose of committing an act or furthering an enterprise which is forbidden by law, or which, though lawful in itself, becomes unlawful when made the object of the confederacy. Conspiracy is a more technical term for this offense. The act of two or more who combine together to do any damage or injuiy to another, or to do any unlawful act. Jacob. See 52 How. Pr. 353; 41 Wis. 284.
