In order to the amendment to have lawfully been ratified all of the 48 states that existed when the amendment was proposed. Article V clearly guarantees that no state can be denied its suffrage in the senate without their consent.
To date 41 states have ratified the 17th Amendment have voluntarily given up their right to be represented in the Senate but;
- Florida,
- Georgia,
- Mississippi,
- Kentucky,
- South Carolina,
- Virginia
