When the Bill of Rights was submitted to the states for three new states joined the Union. Rhode Island, North Carolina and Vermont. They were not states and did not have representatives in Congress when the amendments were being considered in Congress. Should the states that joined the Union after September 25, 1789 be allowed to participate in the ratification process?
Secretary of State. Samuel Otis said determined that states that joined the Union, while the amendment was still pending had a right to participate.
Secretary of State, John Quincy Adams had a different opinion. While the originally proposed 13th amendment was still being considered, Louisiana, Indiana, Mississippi and Illinois joined the Union and he did not allow them to vote on the ratification of the 13th amendment. His position was that there were only 17 states when the amendment was proposed and that only those states had a right to participate in the amendment process.
