Automatic Indictments

In most states the people living in cities and counties can demand that their local representatives pass city and county ordinances that would indict any member of the law enforcement community who used deadly force to cause the death of a suspected criminal.

This ordinance would make the law enforcement community accountable for their actions. Frankly, I do not trust the Grand Jury as they are controlled by the District Attorney and I think the Internal Affairs Department of the Law Enforcement Agency is biased in favor of law enforcement officer who is under investigation.

I believe that if members of the law enforcement community knew before they drew their gun that they would be put on trial before a jury consisting of 12 members of the community, perhaps they would think twice before employing deadly force.

When the victims of police brutality win a law suit, who pays? Does the City or County pay the claim? All members of the law enforcement community are bonded, does this mean that the claims are paid by the bonding agency?

Who pays the premiums to purchase the bonds?

When a San Bernardino Deputy was fired, he won a law suit for wrongful termination amounting to nearly a million dollars. Rather than going to court the County Board of Supervisors agreed to settle the case out of court. Where did the million dollars come from to pay the claim?

  • I beleive that there should be a citizen review committee that has oversight over the law enforcement community. All the facts of the case should be brought in front of that committee and private detectives come in to do any further investigation that is needed.

    Law enforcement officers are involved with the judges, attorney's, and even prosecuters. The system is corrupt and needs to be reformed so the officers should be placed at a desk until the investigation is over. His gun should pulled for ballistics and the residue on his hands should be documented.

    Currently, there is a power struggle going on between the government and the people so why should we trust them to make a proper legal decision on one of their own? 

  • The problem with your idea is committee would likely become corrupted and only some of those who killed suspects would be indicted. I think that every time a suspect is killed it should be up to a jury to decide whether the officer was justified.

    Don't bring the evidence before a committee, bring before a jury and let them decide. I believe that a committee would have the potential to become corrupted.

  • It is my understanding the the bonding company pays the claims and then they seek reimbursement from the guilty party or the guilty parties employer.
