Delaware

On March 18, 1913 the state legislature of the state of Delaware voted to reject the proposed 17th Amendment and July 1, 2010 the legislature of Delaware voted to ratify the 17th Amendment,

Delaware became the 39th state to ratify the 17th Amendment. Maryland ratified the 17th Amendment on April 1, 2012 and Rhode Island ratified the amendment on June 20, 2014. Currently there are 41 states that have ratified the amendment and 7 states that have not.

When Congress allowed Delaware to change their vote from the negative to the affirmative they set a precedent that states may change their ratification vote.

The following states have not yet voted to ratify the proposed 17th Amendment.

  • Utah
  • Florida,
  • Georgia,
  • Mississippi,
  • Kentucky,
  • South Carolina,
  • Virginia,

In the legislatures of six of the 41 states that have ratified the amendment choose to rescind their previous vote in favor of ratification, the amendment would fail to have the required 36 states required for it to be a lawfully ratified amendment.
