The President of the United States is the head of the Executive Branch of government and serves as its CEO. When the President issues an Executive Order it can only apply to the government employees who fall under his jurisdiction. He has no Constitutional authority to dictate to anyone else.
The Constitution prohibits the government from interfering with an individuals right to contract. If an individual enters into a contract to join a country club, the individual is required to agree to the terms of the contract. As a member, the individual is required to obey the rules and regulations associated with the contract.
Individuals who do not belong to the club are not subject to the rules because the club has no jurisdiction over them. For jurisdiction to exist an individual is required to give their consent to the contract. If no consent has been offered there can be no lawful jurisdiction.
