Unratifying the 17th Amendment

When the 17th Amendment was submitted to the states for ratification Alaska and Hawaii had not yet been admitted as states. In for the proposed amendment to be ratified it would need the approval of the legislatures of 36 or the 48. On April 8, 1913, Connecticut became the 36th state to ratify the Constitution's 17th Amendment.

So a total of 41 States have ratified the 17th Amendment and 7 states have not. States which have not ratified the 17th Amendment are as follows;

  1. Florida
  2. Georgia
  3. Mississippi
  4. Kentucky
  5. South Carolina
  6. Virginia               

  States which have not voted in Favor of the 17th Amendment

  • Utah rejected it on February. 26th, 1913
  • Delaware it rejected on March 18, 1913 but then changed their vote and ultimately ratified it on July 1, 1910

If just six States decided to change their vote to No, there would only be 35 states in favor of ratification - one less than the number required for the amendment to remain in effect. This would result in the Amendment being effectively cancelled. Since the 17th Amendment violates the provisions of Article V, which mandates that no state without their consent, can be denied their equal Suffrage in the Senate, the right of the States to be represented in the Senate has been violated. Therefore this Amendment should simply be considered Null and Void, Ab Initio, Ad Infinitum.
